The Nevada legislature will be approaching the second major deadline of the session on Tuesday April 25, 2017.  On Tuesday any bill not designated exempt must pass out of the house of origination or it will be considered dead; therefore, most of this week will focus on floor votes and closing agency budgets.

Update: Fines and Fees Meeting

League supporters,  

Thank you to everyone who attended our meeting on criminal justice fines and fees.  We had an energizing discussion about a very serious problem. 

Here is some brief background information on the topic: While the Nevada constitution mandates funding our court system, it is silent on how to generate the funding. 

Currently, the state generates a portion of this funding from fines and fees paid by Nevada residents.  The thinking behind this is that people who interact with the courts should largely pay for associated services, and if someone wishes to opt out of paying, simply abstain from activities covered by the courts.

 The Nevada Independent’s Megan Messerly covered testimony from Nevada Supreme Court Justice James Hardesty at a legislative budget hearing on January 26, 2017, on this topic.

Fast forward to the Administrative Assessments slide, which is at 1 hour and 50 minutes.

The problem with this underlying reasoning is that it ignores how poverty and mental illness can force individuals into the criminal justice system with little power to extricate themselves. When a person is already living at the margins, and could possibly require medical attention, it can be very difficult to avoid fines and the fees assessed when fines go unpaid.

And once someone becomes locked into a cycle of fines and fees assessed for failure to pay fines, it can be very difficult to escape going to jail. (It should be noted that sending someone to jail increases the system’s costs.)

And sadly, if our courts continue to be funded with fines and fees, there will be a perverse incentive to not take hardships, mental illness, and various other mitigating issues into consideration. Not because our judicial branch employees are unethical, but because we have put them into an impossible situation.

 We therefore decided to pursue this issue further to better understand the scope of the problem as well as to investigate ways we can fund our courts apart from fines and associated fees.

Additionally, our League’s annual planning meeting, during which we lay out projects for the 2017-2018 year, will be on August 5th.  I will put this topic on the agenda.

I want to update everyone on our March 18th community meeting.

League of Women Voters LVV Update: Mental Healthcare Rally

League Supporters,

Thanks to everyone who attended our rally to oppose any cuts to Nevada’s mental health budget!  We had a full house!

For those unable to attend, we heard from Assemblyman Steve Yeager, Senator Patricia Spearman, and Judge Heidi Almase. 

Assemblyman Yeager and Senator Spearman confirmed our assertion that not only should we reject the Medicaid expansion rollback, which will leave 300,000 Nevadans without insurance, we should also not accept that $20 million can be subtracted from our mental healthcare budget without harm to progress already made.

Judge Almase shared her insights and experiences as the presiding judge over a new mental health court.  Judge Heidi shared that we are finally making some progress on diverting mental healthcare patients away from our jails and towards opportunities to receive high-quality treatment and to enter the work-world on equal-footing.  It would be a tragedy to lose this and other fledgling programs just as we are seeing promising results.

Because we’ll be fighting on two fronts—state and federal–to keep the mental healthcare budget whole, we’ll need two related but separate strategies.

First, at the state level, the Governor is proposing cutting $20 million from his budget for mental healthcare based on the premise that we can afford the cut due to the expansion of Medicaid under the Affordable Care Act.  He asserts that more patients will have access to private doctors because of the expansion, so the state therefore won’t need to fund as many services.

There are two problems with this approach.  First, we now know that the ACA replacement plan will end the Medicaid expansion program by 2020; and second, many mental healthcare professionals have testified in legislative hearings that the $20 million could easily be reallocated to other public mental healthcare programs, which are currently under funded.

So, if you agree that a $20 million cut is the wrong approach for Nevada’s mental healthcare budget, please contact your state legislators to express your concerns.  Every Nevadan is represented in Carson City by a state Senator and an Assemblyperson, so you should contact both.

The second strategy is to contact Senator Dean Heller and Representative Mark Amodei, at the federal level, to request that both oppose rolling back the Medicaid expansion through the American Health Care Act.

Yesterday Senator Heller indicated that he did not support the rollback; his action on the replacement plan will be crucial to maintaining Medicaid’s current capacity to cover our most vulnerable neighbors.
