Vote Nevada Update 7/14/2024

Vote Nevada Supporters,

Yesterday, we had our second successful Practice Ranked Choice Voting Zoom event.  Thank you to everyone who attended.  Attendees asked great questions, including one about how the county clerks and registrars of elections feel about implementing ranked-choice voting. 

Luckily, Carson City Clerk Scott Hoen attended and gave his perspective as a clerk.  I spoke with Lorena Portillo, who took over for Joe Gloria as the Clark County elections administrator, so I could share what Lorena told me.  She affirmed that our voting machines include software to manage ranked-choice elections. Still, the software only allows ranking for up to 3 candidates, so we will need a software upgrade to manage 5 candidates.  This will resemble our upgrades to the mail-in ballot signature verification system.

The more significant issues, and Scott’s response, focused on funding for our election operations, from voter registration to counting mail-in ballots to voter education.  We have adopted many election system upgrades over the last twenty years, yet our legislature has often not adequately funded implementation.

Automatic voter registration at the DMV is one example.  We register thousands of people to vote automatically unless the voter opts out. Yet, we spend almost nothing to ensure new voters can access the civics information needed to become confident voters.  We also devote nothing to virtual and in-person practice opportunities where voters can practice casting an in-person or mail-in ballot. 

Creating voting barriers for voters who need civics education is eerily like a time when we used literacy tests to prohibit Black Americans from voting.  And keeping people in the dark about our election processes allows conspiracies to blossom and grow out of control.

A related unfortunate affliction of our political system is how expensive it is to engage in direct democracy opportunities.  Participating in our ballot question process is prohibitively expensive, which means the political parties and wealthy community members have full access, while average Nevadans have almost none.  Organizations and individuals with money can pay lawyers, advertising agencies, and media outlets to shape the reform narrative.  Meanwhile, grassroots engagers have minimal influence over this tool of direct democracy.

Ballot Question 3’s grassroots supporters face this problem.  We are trying to offer as much voter education and chances to practice ranked choice voting as possible but with minimal funding.  

We are doing our best, so please take a little time to learn about the Ballot Question 3 reforms and participate in a practice ranked-choice voting election.

Options to learn about ranked choic voting

In August, Vote Nevada will focus on civics education and civic engagement.  We must start reaching out to our new voters, both first-time and new-to-the-state voters, before early voting begins in October.  Every state manages its elections differently, so even folks who have been voting for many years in other states and just moved to Nevada will need some basic information about our flavor of democracy.

Our voter education and engagement project is called the Shirley Chisholm Democracy Initiative. Because who’s a big Shirley Chisholm fan? Me!

No matter how many political obstacles she faced, Shirley never gave up on voting, running for office, and engaging in advocacy.  Shirley Chisholm Democracy Initiative Project.

Vote Nevada Update 6/20/2024

I am happy to report that voter turnout did go up from 11.5% to 19.11%, which is better but is still very low. https://silverstateelection.nv.gov/vote-turnout/

General election get-out-the-vote and voter education efforts must start now to ensure the highest possible turnout and the lowest possible number of mail-in ballots being thrown out. There are many reasons voters did not turn out, so many strategies are needed to convince voters that elections and their votes matter. It is not acceptable to just label groups as “not real voters.” We must address all barriers to voting.

Some voters are interested in specific issues, while others are looking for candidates they can identify with. Some voters need guidance on how Nevada’s elections work. Understanding what happened in the primary from a data perspective will be useful as we begin this journey.

Vote Nevada Update 6/9/2024

Please use ballot tracking if you vote via mail-in ballot to make sure you can verify your ballot if needed. It is unacceptable for approximately 5,000 voters to lose an important right every election.

Low voter turnout and mail-in ballot errors suggest we need more civics education and voter engagement. We must welcome every voter into our civic community and listen to their issue, including reasons for sitting out. Before I state my plan for engaging voters and non-voters alike, let me explain my approach.

When I started at the College of Southern Nevada in 2003, the demand for online learning exponentially increased semester after semester.  Having classes available without needing to drive to campus on specific days and times opened higher education to many nontraditional students, especially women.  

I took a community college position to help nontraditional students, so I devoted my early years as an educator to learning to teach online.  However, after some time, student data started telling us something was wrong; online student failure rates grew alarmingly.

At that point, we could have said, “Well, these students must not be real students because they are not interested in education,” and have done nothing.  Of course, we did not do this; as educators, we came together to investigate the higher failure rates.  

We discovered three things.  First, many online students were new to higher education and, therefore, were unfamiliar with college culture.  Second, because these students were not on campus, they lacked easy access to on-campus student services, such as tutoring.  Third, while these students were “digital natives,” they were unfamiliar with education technology.

From these findings, we developed recommendations for an action plan.  Telling these students to take in-person classes was not a viable solution; they were online because they needed to be online.  So, we needed to meet them where they were at.

To do this, we asked our administration to create virtual student services and worked with our E-Learning Office to communicate more clearly with students through our course design.  We built student training resources for the e-learning software, and faculty studied best practices for teaching online.  In sum, the faculty introspectively helped our students by being willing to do things differently.

Most importantly, we did not blame the students by dismissing their issues and concerns.  We expected students to demonstrate personal responsibility, but we did so within an environment that provided the tools needed for success. Now, let’s discuss newly registered voters.

In 2019, Nevada adopted automatic voter registration via ballot initiative.  Under this statutory change, anyone applying for an I.D. or driver’s license would automatically be registered to vote unless they opted out.  The voter would also default to nonpartisan affiliation if she/he did not affirm a party selection. Because of this law, many more Nevadans are now registered to vote, yet voter turnout rates are not increasing in tandem.

We cannot accept just blaming voters for their lack of engagement. They know their registration status because they receive a sample and mail-in ballot every election, yet they are not voting. Why? Every state has different election laws and practices, so new Nevadans are unfamiliar with our governing systems and how we manage our elections. So, if we are going to register these new voters, we also must provide them basic civics and election information.  

But how do we offer civics information to new voters without overwhelming them? Our primary election rules can be confusing and frustrating. I speak to new voters regularly, and it can take up to 30 minutes to explain our primary election practices and laws. California transplants, for example, arrive from an open primary system; they are particularly surprised to discover half our races are closed.

Vote Nevada offers a Summer of Civics program on civics education and engagement each year. So, this summer, we’ll focus on why voter turnout is so low and ways to address that problem. Voter education, community engagement, and democracy reform will all be themes.  We need to provide information, but we also need to be open to change.

We are developing a survey tool to understand why voters opted not to vote in this primary election. Please help us distribute the tool as soon as it’s ready to roll.

August and September events will include all ballot questions for the November general election and the importance of down-ballot races.

Nevada’s election registrars and clerks will submit the final primary election results to the seventeen county commissions on June 21st. That is the day we will officially learn the election’s final results, so on June 22nd, from 9 to 10 a.m. via Zoom, Doug Goodman from Sparks will join us for some analysis.

Threat to Direct Democracy

Today, the Nevada Supreme Court ruled that the two ballot initiatives proposing an independent redistricting commission are legally deficient and cannot move forward.  The ruling affirmed the 2022 Reid case that reinterpreted the Nevada constitution to require constitutional amendment ballot initiatives to include a funding mechanism.  Before 2022, it was assumed that constitutional amendments would become mandates requiring the legislature to provide funding.  But now, this has completely changed.

Beyond addressing redistricting to remove gerrymandering from our maps, we need to discuss how to address the loss of direct democracy in Nevada. By affirming the 2022 ruling, the Court has opened the door to every constitutional amendment ballot question being successfully challenged due to an unfunded mandate. 

Ballot question opponents would need only claim that an amendment would require at least $1 in administrative services, and the amendment’s sponsor would be forced to either withdraw their ballot question or add tax policy to their constitutional amendment.

If the sponsor adds a tax, that tax will go into the Nevada constitution alongside the mining tax, and we all know the problems associated with the mining tax being in the constitution. Or the sponsor could increase a statutory tax (a tax that is a law) to pay for the amendment, but then the legislature could just remove the tax from the law to nullify the amendment’s purpose.

None of these options are acceptable.  We need to fight back to keep our constitutional right to direct democracy.

Vote Nevada Update 5/4/2024

One week from today, we are hosting three events featuring Katie Fahey, the young woman who spearheaded Michigan’s successful independent redistricting commission ballot initiative.

The ballot petition process traces its direct democracy ideological roots back to the very beginning of our country.  The initiative, the referendum, and the recall became widespread anti-corruption tools just over one hundred years ago when Progressive reformers viewed this trio as an effective counterbalance to Gilded Age political corruption.

Nevadans established the initiative, referendum, and recall as constitutional rights by amending them into our state constitution in the early 1900s.

Katie’s new organization, Respect Voters, aims to protect the right to run and vote on ballot initiatives in states where it exists and to establish the right to run and vote on ballot initiatives in states where it does not. https://www.respectvoters.org/

Vote Nevada Update 4/26/2024

Vote Nevada Supporters,

Our Candidate Forum tomorrow at the College of Southern Nevada, North Las Vegas Campus, has been jazzed up to include Artists4Democracy.  We invite community members to join us anytime between 9 a.m. and noon to speak with our top ballot candidates and engage with Artists4Democracy to make buttons, customized t-shirts, tote bags, and posters.  We are celebrating civic engagement through art!  All art supplies are provided for free.

Candidates are invited to spend as much time with us as possible, but with many different events scheduled tomorrow, we are accommodating candidate schedules as best as possible.  Community organizations such as Nevada NOW and Open Primaries will also join us to chat about the ballot question process.

Breakfast food and drinks will be available until we run out, so please stop by early for some snacks, juice or coffee, and a big scoop of civics and art.

Event details: Saturday, April 27th, from 9 a.m. to noon, at the CSN N. LV Campus, 3200 E. Cheyenne Ave., 89030, Student Union Ballroom.

The other big news is our events with Katie Fahey from Slay the Dragon, documenting her journey to pass an independent redistricting commission ballot question in Michigan.  Katie has a new national coalition called Respect Voters, which recently kicked off to protect, strengthen, and expand the ballot initiative process. 

Katie will join us in Las Vegas on May 11th at the Clark County Library, 1401 E. Flamingo Rd, 89119, from 3:30 to 5:30 p.m. Katie will speak about her ballot question experience in Michigan and her new coalition and answer questions. We will have refreshments. 

We will have a planning meeting in Las Vegas with Katie right after the Clark County Library event, from 6:30 to 8:00 p.m., at 3481 E. Sunset Rd #111, 89120.  At this second meeting, we will discuss how Nevada can actively protect, strengthen, and expand the ballot initiative process through Respect Voters.  

We are lucky in Nevada to have direct democracy tools to empower us to share in managing our state. However, our process is not threat-free, and many states have no direct democracy options. Therefore, we are in a prime position to play supporting and leading roles in this new coalition. We will have a virtual option.

Our second event with Katie is on May 12th at the Nevada Discovery Museum, 490 S. Center Street, Reno 89501, from 12:30 to 3:30 p.m.  Katie will speak about her ballot question experience in Michigan and her new coalition and answer questions.  We will have refreshments.  Entrance into the Museum after the event is included.
